What is an "Administrative Hearing"?

According to the 2005-2006 Community Standards book, an Administrative hearing generally occurs when one or more of the following situations exists: 1) a resolution does not occur during the educational conference, 2) the student fails to attend an educational conference or to respond to a request for an educational conference, or 3) the severity of the alleged violation or the student's prior judicial history warrants an administrative hearing.  The student will be notified in writing of the charges of violations of the Code.  In the letter, the student will be given the date, time and location of the hearing or will be asked to schedule an appointment.  Administrative hearings are held before either the Peer Judicial Board, an administrative panel, or before an administrative hearing officer. 

During the hearing, the charged student will be asked to enter a plea concerning the charges that have been filed.  After an initial plea, the student will be able to make a statement and present information relevant to the incident being adjudicatd.  Charged students have the right to bring incident witnesses to the hearing.  An incident witness is a person who has direct knowledge of the incident and/or of its details.  The student charged also has the right to bring an advocate, who can provide personal support through the hearing.  The advocate must be a member of the College community (faculty, staff, student, or administrator). 

Administrative hearings are closed to the public and are considered confidential.  Charged students are also able to provide character witnesses (limited to two and must be submitted in writing).  A character witness is a person who can speak to a students overall character and sense of integrity.
